EAST QUARTER CORNER OF SECTION 7, T.112N, R.17W, 5TH

Statement of Evidence:
1853: Thomas Thompson, Deputy
Surveyor, during the US Public Land Survey, set quarter section post in
mound. No witness trees were indicated.
1856: C.H. Allen, surveyor, indicates on the plat of Cannon Falls City Addition a quarter post 63.5’ north of the northeast corner of block 1. The plat also indicates that the block lines are not parallel with the section lines. The plat does not indicate that monuments were placed at the block corners.
Unknown Date: The right of way map of the Chicago, Milwaukee, St. Paul railroad indicates the tracks are 1072 feet south of the quarter corner. No indication was given as to what was used for the corner. Also an angle of 50 degrees was shown in the northeast quadrant of the intersection of the section line with the tracks.
1938: An aerial photograph, found in the county courthouse, dated 7-15-1938, shows occupation lines running east and west from the corner. These east and west occupation lines are south of the road as located prior to its realignment in 1950.
1954: A.E. Rhame, former county surveyor, in survey no. 3815, shows the ¼ corner in the center of the old road being 126 feet south of the center of new county road 17, as realigned in 1950. No monument was indicated at the corner.
1962: E.M. Paulson, former county surveyor, in a survey for Robert Bergeson filed in book 4 of surveys, page 157 shows the ¼ corner 150 feet south of the center of said new county road no. 17. The survey does not indicate a monument in place.
January 1972: Delmar H. Schwanz, registered land surveyor, signed Pine Tree Ridge replat City of Cannon Falls. The north boundary of said plat is the east-west quarter line of section 7. The east quarter is not shown.
December 1972: Delmar H. Schwanz, registered land surveyor, signed Cannon Falls City Addition replat. The plat indicates an iron pipe in place at the ¼ corner.
1981: David A. Johnson, Goodhue County Surveyor, found a 5/8” x 14” iron pipe set by Delmar Schwanz in the middle of the old road bed in perpetuation of A.E. Rhame’s 1954 survey (being 126 feet south of the center of County Road No. 17). A ½” x 30” rerod was also found 24.56 feet south of the above found pipe, at the intersection of fences running north and south with a very old fence running east. Mr. Robert Bergeson, the adjoining land owner, testified that the rod was placed by E.M. Paulson in about 1962 while performing a land survey of land he was acquiring.
A traverse was run along entire east line of section 7 and ties made to the existing intermediate fence positions and railroad. See the face of the certificate for this information. Mr. Deane Skog, the land owner adjoining the corner in section 8, testified that his dad bought the farm in 1914 and that the fence that runs east from the ¼ corner was there then and was always maintained in its present location. He also stated that it was his understanding that the fence was the boundary line of the farm. A check of the record deeds in the courthouse confirms this. The southline of the Skog farm would have been the east-west ¼ line of section 8. Mr. Skog further testified that in 1950, after county road was realigned to the north, he backed into the fence corner to plow. He dropped his plow and began, but immediately struck a stone. He said he got off his tractor and examined the stone and it had a cross “+” in the top, chiseled deep. He said that the stone was in about the same location as the found rerod. Based on Mr. Skog’s testimony, which is substantiated by the 1938 aerial photo, which shows distinct occupation lines south of the road, we accepted the rerod as a perpetuation of the original public land survey corner. The rerod was removed and an aluminum Goodhue County marker was placed.
