NORTH QUARTER CORNER SECTION 28, T.112N, R.18W, 5TH P.M.

 

Statement of Evidence

 

Sept. 1, 1854- A wood post was place at the corner in the P.L.S.

 

Nov. 29, 1941- A survey was made for Herschal Miller by the Goodhue County Surveyor.  The south line of Section 21 was taken at 2 rods north of Herschal Miller’s north fence on parole evidence from Herschal Miller in which he states that the fence was located correctly from an earlier survey.  The distance to the fence of the north side of the road was 21 feet.  H. Miller’s attorney instructed that the survey work be stopped at that time.  The surveyor’s notes show an east-west road on the section line.  A distance of 2642.3 feet is shown between fence lines at the SW corner and S ¼ corner of Section 21, and 2635.5 to the SE corner of Sec. 21.

 

July 7, 1944- A MHD R/W map of Pit No. 3042 shows the south ¼ of Section 21 to be assumed at the intersection of Old T.H. 19 and the fence line north.  The 1941 survey distance is to the fence line south at the ¼ corner.

 

Nov. 26, 1946- A MHD R/W of Pit No. 3042 shows the N-S ¼ line at Sta.523+69.0.  A MHD R/W map shows the SW corner of Section 21 at the intersection of the road E-W and fence N & S and at P.O.T. 497+21.0.  A distance and angle are given from the new Co. Rd. 19 alignment to the old straight road alignment.  Also, the map shows a distance to the SE corner of Section 21 as 2633 feet.

 

May 1, 1975- Placed a Goodhue County cast iron monument at the intersection of the fence line to the north and the computed centerline of the old east-west road.  Even though some of the previous survey distances seem to fit the south fence line better it was decided to use the north fence line for these reasons:

 

  1. It is more logical to use this corner as it is more compatible with bearings on the east and west lines of both section 21 and section 28.
  2. It fits a lost location for distance between the section corners to the east and west (although it is not on line between them).
  3. H. Miller’s attorney stopped the 1941 survey before it was completed and it is felt that the corner may have been placed at the north fence line had it been completed.
  4. The MHD R/W map and legal description call for the north fence line.
  5. The fence to the north is old while the fence to the south is new.
  6. No residents in the area have ever seen the monuments on this section line and aren’t really sure which line is correct.
  7. This location fits the P.L.S distance to the creek better than the south fence.

 

No excavation was done at this location although the M.H.D. excavated with a backhoe 2 years ago at the lost location of the corner and found nothing.  This location yields the following distances to occupation lines.

           To the N.E. corner section 29: 2639.22 feet

           To the N.E. corner section 28: 2639.24 feet

           To the approx. N ¼ corner section 21: 5231.00 feet

           To the approx. center section 28: 2639.53 feet
